Terms of Service

These Terms of Service govern your access to and use of Atlas & Crown — the website, the customer portal, the authentication service, the Registry, the Provenance Vault, the Knowledge Center, and every related feature (together, the “Platform”). They are an agreement between you and Atlas & Crown.

Several parts of the Platform carry their own terms because the subject matter demands it. Those documents form part of this agreement, and where one of them addresses a subject more specifically than this document does, the more specific document governs that subject.

These documents have been prepared for the Atlas & Crown platform but have not yet been reviewed by qualified legal counsel. They are published for transparency, and several provisions — governing law, dispute resolution, liability caps, and statutory privacy rights — are expressly left unstated rather than asserted before that review. We would rather tell you that than imply a certainty we do not have.

1. Acceptance of these terms

By creating an account, submitting a watch, or otherwise using the Platform, you agree to these terms. If you do not agree to them, do not use the Platform.

If you use the Platform on behalf of a company, dealership, estate, or other organization, you confirm that you are authorized to accept these terms for that organization, and “you” means both you and that organization.

2. Documents that form part of this agreement

The following documents are incorporated into these terms and apply whenever you use the part of the Platform they describe:

  • Authentication Services Terms — submitting a watch for authentication.
  • Authentication Disclaimer — what an authentication conclusion is, and what it is not.
  • Certificates & Reports Terms — certificates, reports, and QR verification.
  • Registry Terms — the public Atlas & Crown Registry.
  • Provenance & Ownership Terms — provenance records, ownership records, and transfers.
  • User-Submitted Content Terms — photographs, documents, and other material you upload.
  • Intellectual Property Notice — our rights and your permitted use of our material.
  • Manufacturer & Third-Party Notice — our independence from watch manufacturers.
  • Privacy Policy and Cookies & Tracking Notice — how we handle personal information.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to hold an account. The Platform is not directed at children, and we do not knowingly create accounts for them.

We may decline to open an account, or decline a submission, at our discretion — including where we cannot satisfy ourselves as to the identity of the account holder or the provenance of a watch.

4. Your account

You are responsible for your account and for everything done through it. That means keeping your credentials confidential, using a password you do not reuse elsewhere, and telling us promptly if you believe your account has been accessed without your authority.

We strongly recommend enabling two-factor authentication. Certain sensitive actions — notably ownership transfers — may require additional verification before they will complete.

Accounts are personal to the account holder. Do not share an account, sell it, or transfer it to someone else.

5. Accurate information

The Platform produces records that other people may rely on. Accuracy is therefore not a courtesy — it is a condition of use.

You agree that the information you give us — about yourself, about a watch, about its history, and about your relationship to it — is true and complete so far as you know, and that you will correct it if you learn it is wrong.

6. Permitted use

You may use the Platform to manage your own collection, to submit watches you are entitled to submit, to maintain records for those watches, to verify a certificate presented to you, and to read our published research.

7. Prohibited use

You must not:

  • Submit a watch you do not own or are not authorized to submit.
  • Impersonate another person, or claim ownership of a watch that is not yours.
  • Upload forged, altered, or misappropriated documentation.
  • Reproduce, alter, or partially present an Atlas & Crown certificate or report in a way that misrepresents our conclusion.
  • Create or circulate anything designed to resemble an Atlas & Crown certificate, report, or Registry record.
  • Attempt to gain access to accounts, records, evidence, or administrative functions that are not yours.
  • Scrape, bulk-download, or systematically extract the Registry, the reference catalog, or the Knowledge Center.
  • Probe, load-test, or interfere with the Platform’s security or availability, or circumvent rate limiting.
  • Use the Platform to facilitate the sale of counterfeit goods, or to launder the history of stolen property.
  • Use material from the Platform to develop or improve counterfeit watches or counterfeit documentation.

8. Authentication submissions

Submitting a watch is governed by the Authentication Services Terms, which cover what we examine, what we require from you, and how a conclusion is recorded. The nature and limits of an authentication conclusion are set out in the Authentication Disclaimer. Read both before you submit.

9. Content you submit

You keep ownership of everything you upload. You give us the permissions we need to run the service on your behalf — no more. The scope of those permissions, and the representations you make when you upload something, are set out in the User-Submitted Content Terms.

10. Certificates, Registry, and records

Certificates and reports are governed by the Certificates & Reports Terms. Public Registry entries are governed by the Registry Terms. Provenance entries, ownership records, and transfers are governed by the Provenance & Ownership Terms.

Records we create — inspection findings, decisions, certificates, audit entries — remain our records. We maintain them, and we may correct, supersede, or revoke them in line with the relevant document.

11. Third-party information

Parts of the Platform present information that did not originate with us — material supplied by users, by manufacturers, by dealers, or drawn from archives and published sources. Where that is the case, the interface says so. We do not adopt third-party information as our own finding merely by displaying it. See the Manufacturer & Third-Party Notice.

12. Availability and changes to the Platform

We aim to keep the Platform available and accurate, but we do not promise uninterrupted access. We may change, suspend, or discontinue features, and we may perform maintenance that makes parts of the Platform temporarily unavailable.

Where a change would materially affect certificates already issued or records already published, we will take reasonable steps to preserve the ability to verify them.

13. Suspension and termination

You may stop using the Platform at any time and may request deletion of your account from your account settings. Deletion is subject to a grace period, and some records are retained — see the Privacy Policy and the Provenance & Ownership Terms.

We may suspend or close an account where we reasonably believe there has been fraud, impersonation, a false ownership claim, misuse of a certificate, a threat to another user or to the integrity of the Platform, or a material breach of these terms.

14. Disclaimer of warranties

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted or error-free, that reference data is exhaustive, or that any third-party information presented on the Platform is accurate.

15. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, nor for lost profits, lost business, or the loss of an anticipated transaction, arising from your use of the Platform.

Nothing in these terms limits liability for fraud, for fraudulent misrepresentation, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be limited.

16. Your responsibility for your own submissions

If a third party brings a claim against us because of something you submitted — a watch you were not entitled to submit, documentation you did not have the right to upload, an ownership claim you were not entitled to make, or a misuse of a certificate — you agree to be responsible for the reasonable costs and losses we incur as a result, except to the extent they arise from our own act or omission.

17. Governing law and disputes

This does not affect any mandatory rights or protections available to you under the law of your own country of residence.

If you have a complaint, contact us first. Most issues are resolved faster that way than through a formal process.

18. Changes to these terms

We may revise these terms. Each document in the Legal Center carries a version identifier, an effective date, and a last-updated date, so you can tell which version you are reading.

For a change that materially affects your rights or obligations, we will give notice through the Platform or by email before it takes effect. Continuing to use the Platform after a revised version takes effect means you accept it.

19. General

If a provision of these terms is held to be unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours as part of a reorganization or a transfer of the business, provided your rights are not reduced.
